Information we collect

Information collected about Visitors: Like other website operators, ProStars collects information of the sort that web browsers and servers typically make available through the use of commonly-used information-gathering tools such as cookies (please see “Our use of cookies,” for details). This usage information may include the Visitor’s geolocation information, IP address, device and connection information, browser information and web-log information, language preference, referring site, and all communications recorded by Users through the Website. and the date and time of each Visitor request. ProStars’ purpose in collecting that information is to better understand how our Visitors’ use our Website to improve the user experience, personalize the browsing experience and for monitoring the Website for questionable behaviors and content.

Information collected about Users: You may visit our Website without creating an account, but you will not have full access to our Service. Visitors who wish to use the Service must create an account, thus becoming a User. There are two types of Users referred to in this Policy:  the client user referred to as “the Biz User”, and the professional services Pro User referred to as “Pro User”, collectively referred to as “Users”.  To create an account, Users must provide ProStars with personal contact information, such as name and email address (please see “Gathering and protecting the information we collect,” for details about how we protect this information).

The account creation process may create information about a User which could, alone or together with other information, personally identify him or her (“User Personal Information”). ProStars collects User Personal Information only with your consent which you express by using our Service after reviewing this Privacy Statement and ProStars’ Terms of Use. User Personal Information may include information you provide us directly, such as your email address, or information we collect through your use of our Services, such as your preferences or your search terms. User Personal Information may also include, without limitation, your name, your email address, your billing address, your credit card or banking information, your profession, your business or industry, your photograph, and all communications recorded by Users through the Website, and other personal information you provide to us through your use of the Service.

We only gather the information you give us access to, and we only use it as described below. We only collect the minimum amount of personal information necessary or appropriate to fulfill the purpose of your interaction with us or to serve you more relevant offers.

Once you register, your username and additional information regarding your activity is made public and may be visible to all Users of the Website. This information includes photos you upload, your published portfolio, Project information, ratings, and additional information you may choose to add to your profile.

You may refuse to supply personally-identifying information; however, that refusal may prevent you from using ProStars’ Service.

No information about children: Our Website is not intended for minors under 18 years of age. No one under age 18 should provide any personal information to or on the Website. ProStars does not knowingly collect information from, or direct any of our content specifically to, minors under the age of 18. If we learn or have reason to suspect that a User of our Service is under the age of 18, we will promptly delete any personal information in that User’s account.

Location-based data: ProStars also makes use of location-based data for our Website. If you utilize our Services, we will ask you to enter your general location. We use this information to provide Services to you or to serve you more relevant offers, not to personally identify you. If you choose not to provide ProStars with your location, some or all functionality may not be available to you.

Confidentiality and Postings: In order to access the Service, Biz Users may post certain information via an online form. This information may include, among other things, a description of the Biz User’s business and professional services needs. This posted Project will be viewed by those Users who have access to view posted Projects and may be viewed by ProStars employees or representatives of ProStars to ensure quality control and provide technical support. Posted Projects will only be visible to the originating Biz User (or other Biz Users from the same company as specified by the original Biz User), any Pro Users registered on the Website, as well as to ProStars employees. Therefore, no Project is confidential. If you share sensitive or confidential information via the Service, you acknowledge that you understand and agree to assume these risks involved.

How we use the information we collect

To provide the Services you request: ProStars uses User Personal Information to perform and provide the Services you request. For instance, we use User Personal Information to allow Biz Users to select the best Pro User(s) for their needs, facilitate communication between Pro Users and Biz Users, and simplify invoicing and billing for Projects. We use location-based data to allow Pro Users to bid on Projects in their local area and jurisdiction and allow Biz Users to filter candidate Pro Users. User Personal Information is also visible in online profiles.  We may use the information collected from you to verify your identity. We may also use this information to establish and set up your account, verify or re-issue a password, and log your activity on the Website.  The information helps us improve our services to you and customize your experience on the Website. In addition, this information helps us track any fraudulent activities and other inappropriate activities and monitor content integrity

To maintain appropriate business records: ProStars may use User Personal Information to comply with lawful requests by public authorities and to comply with applicable laws and regulations or as otherwise required by law. Should you ever deactivate your account with us, we will keep your information for a limited period in order to meet the above purposes.

To communicate with Users: ProStars may also use User Personal Information to communicate with Users. For instance, ProStars may use information you provide to send you information regarding our Services, such as notifications for action; notifications of promotions or events; to provide you with technical support; to solicit feedback about our Service; or to notify you if our policies change; or to serve you more relevant ads or promotional offers.

To improve our Service: ProStars may use aggregated, non-personally identifying information gathered from our web server to operate, improve, and optimize our Website and Service.

How we retain the information we collect

In general: ProStars applies a general rule of keeping User Personal Information only for as long as is required to fulfill the purpose for which it was collected. However, in some circumstances, we may retain your User Personal Information for longer periods of time. We may retain your information for the following purposes:

  • as long as it is necessary and relevant for our operations, e.g. so that we have an accurate record of your dealings with us in the event of any complaints or challenge; and
  • we may retain information from closed accounts to comply with applicable laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Website terms and take other actions as permitted by law.

How we share the information we collect

In general: We do not disclose User Personal Information outside ProStars, except as described below under “Compelled Disclosure.”

With your consent which you grant by using our Service after reviewing this Privacy Statement and ProStars’ Terms of Use: ProStars may provide your personal details including the information you have chosen to share in order to post or bid on a Project to third parties, only in order to operate the Website, provide our services to you, fulfill obligations imposed on us by applicable laws and regulations, and prevent fraud and illegal activities, as detailed below:

To our employees, other affiliates and third-party service providers: ProStars discloses User Personal Information only to those of our employees, third-party services (example – payment vendors, CRM systems, forum hosting, community management services, mailing systems or technical consultants), and affiliated organizations that need to know this information in order to process it on our behalf or to provide or improve our Service.  Consistent with applicable legal requirements, we take commercially reasonable steps to require third parties to adequately safeguard your personal information and only process it in accordance with our instructions; Some of our employees, contractors, and affiliated organizations may be located outside of your home country; by using ProStars’ Service, you consent to the transfer of such information to them. Please see “Gathering and protecting the information we collect,” for more details.

If you upload a document: If you choose to upload a document by using our documents features, only ProStars Users may view such documents. The documents are only accessible to the other parties involved in the transaction relevant to the document.  For example, all Project deliverables for a specific Project (Statement of Work, Milestone Deliverable, etc.) will only be visible to the Biz Users and Pro Users who are engaged in that specific Project.

In a merger: ProStars may share User Personal Information if we are involved in a business transaction such as a merger, sale, transfer of all or a portion of ProStars’ assets, acquisition, bankruptcy, or similar event.  If any such change of ownership happens, we will seek to continue to ensure the confidentiality of User Personal Information, and we will notify you on our Website before any transfer of User Personal Information. The purchaser will be required to honor any promises we have made in this Privacy Statement or in our Terms of Use.

To secure and protect the site against fraud, unauthorized transactions (such as money laundering), claims or other liabilities:  ProStars does not collect credit information, but allows our payment vendors to collect information for the purpose of collecting payments from Biz Users on the Website or transferring payments to Pro Users on the Website. We are not exposed to the payment information provided to our payment vendors, and this information is subject to the privacy policy applicable to the payment vendor.

Third-party tracking: The Website may contain links to third-party sites and if you link to a third-party site from the Website, any data you provide to that site and any use of that data by the third-party are not under the control of ProStars and are not subject to this Policy. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third-party, nor is it an endorsement of their privacy or information security policies or practices. You should consult the privacy policies of each site you visit. This Policy applies solely to personal information collected by our Website. If you upload content, including your personal information, to a social network and then tag the Website, your submission will be subject to that social network’s terms of use and privacy policy. We do not have control over these terms of use and privacy policies and have not reviewed their adequacy. You should therefore review these before submitting any personal information.

General information about Users: ProStars may disclose aggregated User non-personally identifiable information about how our Users, collectively, use our Service, so that we may share general information about our Service, such as statistics about the average cost of professional services.

Our use of cookies

Cookies, generally: When you visit the Website, ProStars may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer and which will allow us, among other things, to make your browsing more convenient and effortless and allow us to test user experience and offer you personalized browsing or promotions. By continuing to use this Website, you are agreeing to our placing cookies on your computer or device in accordance with the terms of this Policy.  A cookie is a small piece of text that our web server stores on your computer or mobile device, which we can then retrieve as needed. We may use persistent cookies to enable us to remember you each time you visit our Website; keep track of your preferences in relation to your use of our Website; allow you to log in without re-entering your password every time you visit; and serve you more relevant advertisements or promotional offers.

Google Analytics: ProStars may use Google Analytics to obtain an overall view of user habits and volumes, and to help improve the overall experience on the Website. Google Analytics uses both session-based and permanent cookies to collect information about how our Website performs and how our Users use the Website and Service. The Google Analytics tool helps us evaluate and monitor Users’ use of our Website, compile statistical reports on activity on the Service, and improve our content. Google Analytics may collect more information than ProStars collects including your IP address and transmit and store that information on servers operating by Google, Inc.

ProStars will not, nor will we seek to allow any third-party to, use the Google Analytics tool to (i) track our Users, (ii) collect any User Personal Information other than IP address, or (iii) correlate a User’s IP address with his or her identity or other data held by Google. You can prevent Google’s collection and use of data (cookies and IP address) by downloading and installing a browser plug-in.  This creates an opt-out cookie which prevents the further processing of your data. Gathering and protecting the information we collect

Data security: ProStars takes commercially reasonable steps to protect User Personal Information from unauthorized access, alteration, or destruction; maintain data accuracy; and help ensure the appropriate use of User Personal Information. ProStars follows generally accepted industry standards to protect the User Personal Information submitted to us, both during transmission and once we receive it. No method of transmission, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

No responsibility for third-party service providers’ security: We may store your data on servers provided by third-party hosting vendors with whom we have contracted. While we take measures reasonably necessary to ensure that our third-party service providers, such as our payment processing and data tracking, re-targeting or data analysis services, keep your information secure, these organizations’ practices are ultimately beyond our control. By using our Service, you acknowledge that you understand and agree to assume these risks.

Documents, in general: ProStars stores uploaded documents on our Website related to the Services provided by the Website.  This includes, but is not limited to, documents related to posts, Projects, interviews, and other related deliverables. ProStars follows generally accepted industry standards to protect the documents submitted to us, both during transmission and once we receive it. No method of transmission, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. By using these features, you acknowledge that you understand and agree to assume the risks.

OAuth, in general: ProStars may make use of the industry standard OAuth authentication protocol. OAuth is a simple, secure process that allows you to grant ProStars access to your accounts on third-party networks without sharing the passwords to those accounts. Using OAuth, the data you choose to share is securely transferred without revealing your login information. OAuth also allows you to verify that an application acting on your behalf is doing so only with the permissions you have granted it. Most social networks, such as LinkedIn, Twitter, Facebook, and Google, allow applications to access user accounts via the OAuth process. OAuth functions using authentication tokens, which will expire after a period of time and may be revoked.

International data transfer: Information that we collect may be stored and processed in and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this privacy policy. By using the Service, you agree that we can store, process and transfer your information in this manner.

Compelled Disclosure

ProStars may disclose both User Personal Information and non-personally identifiable information to respond to a subpoena or court order, judicial process or to regulatory authorities, if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes; when we believe it necessary or appropriate to disclose personal information to law enforcement authorities, such as to investigate actual or suspected fraud or violations of law, breaches of security, or breaches of this Policy; to respond to claims against us; and to protect the rights, property, or personal safety of ProStars, our customers, or the public.

In complying with court orders and similar legal processes, ProStars strives for transparency. When permitted, we will make a reasonable effort to notify Users of such disclosure.

Your access to and control of the information we collect

Access to User Information: As a ProStars User, you may access, update, alter, or delete your basic User profile information by editing your user profile or contacting info@prostars.com.

Deletion of User Information: If you wish to cancel your account, delete your User Personal Information, or request that we no longer use your User Personal Information to provide you Services, please contact info@prostars.com. We will retain and use your User Personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  Please see “How we retain the information we collect” for more details.

Control of communications from us: ProStars may occasionally send Users communications (via email, notification, SMS message, phone call, or targeted online advertisement) to tell you about new features, solicit feedback, notify you of important changes, or just keep you up to date with what’s going on with ProStars and our Services. You may manage your receipt of these communications by clicking on the “unsubscribe” link located on the bottom of ProStars’ emails or manage your notifications options in the “Settings” panel of your User Profile. Additionally, you may send a request specifying your communications preferences to info@prostars.com. Please note that if you do opt out of promotional mailings, we may still send you important administrative emails or notices that affect your rights.

California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If you are a California resident under the age of 18, and a registered user of our Site, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted.
